Cake Testers - Terms & Conditions
1. Promoter
This programme is operated by Imaginakery Limited, trading as Jungle Squad, company number 14977878, registered office 4th Floor, 95 Gresham Street, London, EC2V 7AB (“Imaginakery” or “Promoter”).
2. Programme Overview
The Jungle Squad Cake Tester Programme offers selected participants the opportunity to receive sample cake products free of charge in exchange for providing an honest review in the form of:
- A video, and/or
- A photograph, and/or
- A short written testimonial accompanying submitted content.
No purchase is necessary.
The Promoter reserves the right to determine the number of participants selected and the quantity of products distributed as part of this programme.
3. Eligibility
- Open to UK residents aged 18 years or over.
- Employees of the Promoter and their immediate families are not eligible.
- Participants must be the parent or legal guardian of any child featured in submitted content.
- Only one entry per household unless otherwise agreed by the Promoter.
4. Application & Selection
To participate, applicants must:
- Respond to the invitation or application request within the stated timeframe.
- Join the Founding Families Facebook group.
- Provide a valid UK delivery address.
- Confirm acceptance of these Terms.
Participants will be selected from eligible applicants at the Promoter’s discretion.
Selection is final and no correspondence will be entered into.
This programme is not a prize competition, lottery or regulated promotion.
The Promoter reserves the right to limit, expand or vary the number of selected participants at any time.
5. Product Dispatch & Food Safety
Products will be dispatched free of charge to the address provided.
Participants are responsible for ensuring that:
- The delivery address is accurate.
- Someone is available to receive the parcel.
- Products are stored according to on-pack instructions.
- Products are consumed before the stated best before date.
Allergen & Dietary Notice
Full ingredient and allergen information will be clearly provided on-pack.
Products are produced in facilities that handle allergens including (but not limited to) gluten, dairy, egg, soy and nuts.
By participating, you confirm that:
- You will check ingredient and allergen information before consumption.
- You will not provide the product to anyone with a known relevant food allergy or intolerance.
- You understand that Imaginakery cannot accept responsibility for allergic reactions where allergen information has been clearly provided and reasonable care has been taken.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, defective products, or any matter that cannot legally be excluded.
6. Content Submission Requirements (Video or Photo)
Participants agree to provide an honest and genuine review in the form of:
- Video footage, and/or
- Photographic images, and/or
- Accompanying written comments.
Content must:
- Reflect genuine opinion and experience.
- Not include false or misleading claims.
- Avoid including copyrighted music, brands, or identifiable third parties without permission.
- Be lawful, non-defamatory and appropriate.
If children appear in the content, the participant confirms they are the parent or legal guardian and consent to their inclusion.
Imaginakery may edit submitted content for clarity, formatting or length but will not materially misrepresent the participant’s overall opinion.
Original copies may be retained for compliance and record-keeping purposes.
7. Content Licence & Image Rights
By submitting any video, photograph or written content, you:
- Confirm you have the right to grant the permissions below.
- Grant Imaginakery a perpetual, royalty-free, worldwide, non-exclusive licence to use, reproduce, edit, publish and distribute the content, including your name, likeness and voice (and that of any child you are legally responsible for) for marketing and promotional purposes.
- Waive any moral rights to the extent permitted by law.
8. Data Protection
Imaginakery will process personal data including name, email address, postal address and submitted image/video content for the purposes of:
- Administering this programme
- Delivering products
- Reviewing and publishing content (where consent given)
Lawful basis:
- Contract (administration of participation)
- Consent (use of images, video, likeness and testimonials for marketing)
Data will be retained:
- For up to 12 months for administration records.
- Marketing materials may be retained for ongoing brand use unless consent is withdrawn.
9. Limitation of Liability
Imaginakery will not be liable for:
- Delivery delays outside its reasonable control.
- Incorrect address details supplied by participants.
- Failure by participants to follow storage, allergen or usage instructions.
Nothing in these Terms limits or excludes liability for:
- Death or personal injury caused by negligence.
- Fraud or fraudulent misrepresentation.
- Liability under the Consumer Protection Act 1987.
- Any matter which cannot legally be excluded.
10. Disqualification & Conduct
The Promoter reserves the right to disqualify participants who:
- Provide false or misleading information.
- Submit unlawful, offensive or inappropriate content.
- Attempt to manipulate or abuse the programme.
11. Programme Changes
The Promoter reserves the right to amend, suspend or withdraw the programme where reasonably necessary due to circumstances beyond its control or for operational reasons.
12. Governing Law
These Terms are governed by the laws of England and Wales.
